Rules of Transport – Fanøtrafikken A/S
For transport by Fanøtrafikken, the following conditions for responsibility, liability and limitation of liability shall apply to passengers, vehicles and luggage conveyed by our ferries or by a ferry chartered by us.
In all other respects, Fanøtrafikken has limited liability in damages for faults, as well as for personal injury and property damage in accordance with the rules of the Danish Merchant Shipping Act of 1994.
Tickets
Booking is not available for the ferry line Esbjerg-Fanø.
Tickets and cards for vehicles are available for purchase at the automatic check-in automats, and passenger tickets are available for purchase at the terminal in Esbjerg. Tickets are valid for the next vacant departure. The passenger must keep the ticket for the entire trip. The passenger must present the ticket on demand.
If a customer has mislaid or lost his ticket, a new ticket must be purchased.
Refunds
Tickets are refunded by cancellations.
Outdated/lost tickets are not refunded. No ticket may be refunded more that 12 months after last date of validity.
Generally, Fanøtrafikken’s 10 Trip Cards, 30 Trips Cards, Monthly Cards and Annual Cards are valid for 12 months after purchase date. If other conditions apply, this will be stated on the cards.
By the refund of cards that are partly used, the customer pays the ordinary fare per realized trip at the actual time. An expedition fee of DKK 75 will be charged and the rest amount will be paid out to the customer.
Monthly Cards and Annual Cards are not refunded.
A customer requesting a refund must send the original ticket(s) and card(s) to Fanøtrafikken A/S, c/o Nordic Ferry Services, Dampskibskajen 3, DK-3700 Rønne, att.: Agentsupport, stating a bank account number to which the amount of refund can be transferred.
Trips
Fanøtrafikken informs on prices and discounts on the website www.fanoetrafikken.dk. Information on current prices is also available by contacting Fanøtrafikken.
If an ambulance, a police vehicle or a hearse (with mourners) requires transport and the departure is sold out, booked vehicles arriving last will be put in a waiting position.
Safety Conditions
Due to the risk of fire, smoking and the use of open fire on the car deck or in the vehicles onboard is forbidden.
Before leaving the vehicle, the driver must set the handbrake and put the vehicle into 1st gear.
The passenger areas are surveyed by video. Any kind of theft will be handed over to the police.
Transport of sick /disabled persons
Fanøtrafikken can require that sick / disabled persons bring a personal helper during the trip.
Fanøtrafikken cannot nurse sick / disabled persons onboard.
Fanøtrafikken does not offer any kind of assistance to sick /disabled persons in connection with their boarding or leaving the ferry.
Transport of persons and vehicles
(a) Any driving to, on and from the ferry is carried out in cooperation with the ferry crew and involves special watchfulness of the driver.
Fanøtrafikken assumes no liability for damage or losses that occur due to missed warning signs, misunderstood (Crew) instructions or the like.
(b) Fanøtrafikken assumes no liability for damage or losses that occur due to roadworks, confused traffic conditions, lack of marking or instructions, abnormal water level or other conditions and that occur when a passenger is driving on the terminal areas, the ramps or the like, even though Fanøtrafikken or its staff could have taken these conditions into consideration at the time, when the passenger passed a drive-in automat, a foot bridge or boarded or left the vessel.
(c) Fanøtrafikken assumes no liability for any damage to a vehicle that is caused by the fact that the vehicle is lowered, rebuilt or heavy loaded. Special equipment including luggage placed outside or on a vehicle and damaged while the vehicle is moving is not being replaced.
(d) Fanøtrafikken assumes no liability for any damage to a vehicle caused by another vehicle through crashing, pushing or turning over. Such cases are to be settled between the owners of the vehicles and their insurance companies.
(f) Fanøtrafikken assumes no responsibility or liability for luggage, including hand luggage, or other effects lost on the vessels or in the terminals.
Other conditions for transport of persons
If a person poses a safety risk or is a nuisance to other passengers, crew members of if a person does not follow the direction given to him/her by Fanøtrafikken’s staff, Fanøtrafikken can exclude this person from transport, even if he/she has a valid ticket. Also an intoxicated person can be excluded from transport, even if he/she has a valid ticket.
Damage to Fanøtrafikken’s inventory and properties of other persons will be subject to a claim for compensation.
Coach trips
When transporting coaches, Fanøtrafikken limits its liability according to the rules of the Danish Merchant Shipping Act, Section 13.
Freight
All vehicles with a total weight of over 3,500 kg are designated as lorries.
Any vehicle must be equipped with lashing fittings for attachment to the ship. The goods must be adequately lashed and secured to resist any action caused by transport at sea.
The carrier/driver is personally responsible for ensuring that the load is justifiably lashed and secured on his vehicle.
The decision of the Chief Officer is final with regard to securing loads/lashings, or if a load is refused, if necessary
For the conveyance of live animals, the driver must inform Fanøtrafikken of this not later than at the time of boarding the ferry.
Dangerous goods are to be conveyed in accordance with the regulations of the IMDG code. Fanøtrafikken must be notified in writing of the dangerous goods to be conveyed not less than 24 hours before the transport is to occur. Liquid may not drip from any vehicle. Fanøtrafikken assumes no liability for any damage that occurs to vehicles and freight while parked in waiting/harbour areas.
With regard to the conveyance of lorries, as well as freight transported by these, Fanøtrafikken limits its liability pursuant to Section 13 of the Danish Merchant Shipping Act.
Compensation for personal injury and damage to luggage
According to the conditions stated in the rules of the Danish Merchant Shipping Act, Section 15, Fanøtrafikken limits its liability for the transport of passengers and luggage, including vehicles, handheld luggage and valuables. In terms of compensation for injury or damage claimed in accordance with the rules stated, Fanøtrafikken is entitled to deduct own risk.
With regard to the conveyance of passengers, Fanøtrafikken assumes no responsibility or liability for incidents happening before the passenger boards the vessel and incidents happening after the passenger has left the vessel.
During the transport, no luggage may be conveyed, including handheld luggage, that constitutes a hazard or a significant nuisance to ship, human lives or other luggage/freight; No substance or goods prohibited pursuant to the IMDG Code may be conveyed.
As a carrier, Fanøtrafikken assumes no liability for the loss of or damage to money, securities and other valuables such as silver, gold, watches, jewels, jewellery and art objects.
Lorries, coaches and similar vehicles including cargo of the vehicles, are transported as freight and are conveyed according in the rules of the Danish Merchant Shipping Act, Section 5.
Service delays and cancellations
If a passenger chooses to discontinue a trip because of a prolonged delay, or because a travel connection could not be made, the passenger is entitled to a refund of the ticket for the part of the trip which could not be carried out as a result of the delay.
Fanøtrafikken assumes no liability for any lack of space on the vessels or for operational disruptions, including service stoppage. In such cases, Fanøtrafikken will try to reduce the inconvenience to the passengers.
Fanøtrafikken assumes no liability for damage or losses that occur due to irregularities of service including Force Majeure, technical causes, water and weather conditions. Fanøtrafikken reserves the right to change time tables and prices without any notice. At any time, another vessel than the vessel having been published to carry out the trip can be put into service. Fanøtrafikken is never responsible for losses that occur in connection with lost travel connection or necessary changes of itinerary, including extra hotel stay or similar that a passenger chooses as a result of a delay.
Pets
Dogs must be kept on a short leash. Other animals must be confined in a cage / transport box and may not be any nuisance to other passengers.
The full responsibility for the transport of living animals on the vessel lies with the person or the company that transports the animal.
Lost property
When asking about property lost onboard the ferry, please contact Fanøtrafikken. Lost property is kept for 1 month,
after which time it is handed over to the police according to the Danish Law of Lost Property.
Complaints
Damage to personal property, vehicles or freight must immediately be reported to one of the ferry’s crew members before the passenger leaves the vessel.
Complaints about matters regarding the trip that have not been solved by contacting Fanøtrafikken’s staff onboard, can be forwarded to Fanøtrafikken’s via its customer addressing system on the www.fanoetrafikken.dk/kontakt-internet/
The complaint must be received by Fanøtrafikken no later than 14 days after the occurrence of the incident leading to the complaint.
